Should Employee pay for damages?

We all know that accident happens, if an employee accidentally breaks or damages equipment, will you require him to pay for replacement equipment? Some workers may purposely damage equipment, or out of gross negligence. Since you may not actually know if the damage is done on purpose or not, will you allow them pay for the damages be it on purpose or accidentally?
I think making employees pay for damages will make them cautious. However such damage can be treated as business expense. You can request for replacement of damaged equipment if it's done out of negligence

an employer may validly ask for compensation, especially since the courts have considered that an employee's recognition of their liability or debt to their employer has no effect. Similarly, a clause in an employment contract that holds the employee liable for damage in circumstances other than those referred to in Article L 121-9 will be void. Some situations are more specific – for example, where an employee damages a company car to which they were given access for professional and private use during the course of private use. In this situation, the application of Article L 121-9 of the Labour Code should be excluded.

As sad and unfortunate as it may sound, practices such as "an employee paying for the damages he or she made" is very much in use in my county today. I am seriously against these practices because it is almost impossible to achieve a completely perfect working environment and there is no way there wouldn't be mistakes when working.

Lol why shouldnt mployees pay for damaged. If the equipment was damage through recklessness or carelessness the employee need to pay but if the equipment was damage during operation u see no reason why the employee should pay.

Mistakes happen. Anyone can get anything damaged. If it was done accidentally, the employee will not have to pay. But if it was through sheer negligence or intentionally, such employee will have to replace it. Some employees are known to be careless and repeatedly destructive. Such will keep replacing until they eventua get replaced.

If an employee accidentally breaks or damages goods, you may not need to pay for replacement equipment. Accidents happen. Thedamage should be considered as a business expense. You may only need to pay an employee for damaged goods, if the damage was done for a purpose or out of negligence.

It depends on the condition the person use to start the work or depending the type of person that is doing that work or the type of the things the worker damage. But all this thins depends on there manager or there director if he say yiu will replace it then you will do that

You may ask a worker to refund damaged equipment – with some restrictions. When you have a minimum salary for an employee who has broken a piece of machinery, your wages cannot reduce anything because it will lower your hourly pay below the federal minimum wage. It is prudent to plan and include in your employee manual or training materials a "damage to company property policy" templale.

This issue is a very sensitive one and must be treated as such in order not to violate the human right of each individual person involved either employee or employer. It is important to establish what the company law says. Is it an offence to vandalize or break a company property. In a case of an accidental damage, how does the company law treat such? I believe if these have been well spelt out before an employee is employed then it is fair to request for replacement or payment in the event that company's property has been wrongly handled.

In the event that a representative coincidentally breaks or harms hardware, you can't expect him to pay for substitution gear. Mishaps occur. The harm should be treated as an operational expense. You can just require a representative to pay for harmed gear, if the harm is done intentionally or due to net carelessness.

This dependd on conditions you started with .Secondly, everything in life has to do with risk. So, It should be part of business plan to make sure there is an insurance to cover uncertainty . Let there be insurance cover for your staff in the course of your business
True. Your points are very valid. The business agreement you had at onset with your employee. Insurance is a risk all business should take. Especially established ones. Employees wouldn't be made to pay for such unintentional damages

After an employee is hired, compensation and benefits still play a major role in retention and motivation. If an employee feels that they are receiving a good compensation and benefits package from a company, they are more likely to work harder. Most people are driven by the money and benefits they receive at a job

Yes employees need to pay for damages, this allows them handle office equipment with care and caution, I remember a staff who used to handle a kitchen equipment carelessly because we had the spare parts available, the day she got it broken she was made to pay for it and henceforth she handled things gently.

In some company if any employee acidently do damage or breaks any then he should always pay for that because in conpany there is no reason acceptable for accidently or by doing on purpose. In few of company boss realized that employee done by mistake any damage..

If an employee mistakenly break or damage the company equipment, you cannot require him/her to pay for the replacement of the damaged equipment, unless the employee always damage and causing loss to the company,The employer must follow a fair procedure and give the employee a reasonable opportunity to show why the deductions should not be made.

Absolutely. Employees should pay for damage caused by them. I believe this will help them to be very careful in the work place. Some people can be extremely careless not minding the implication their carelessness can cause. Employers should place prices on things if damaged by any employee in the work place.

They accepted failure is part of business and life as a whole, learned from it and continue their journey to success.
As an entrepreneur, we should know that success and failure are linked.
I have failed as an entrepreneur in the past and it wasn't easy to accept it

I do not think it is good or right way to demand for damage pay, it should not be in any kind of field. If some one break deliberately then he would have to pay but if accidentally then we can not say, so like these thing avoid and ignore, plus you can also warn him no to do next time

Regardless of the mistake, no employer will pay compensation to the employee. Can find ... With a clear, signed written agreement, the employer cannot deduct money from an employee to cover the cost of damages.
