Renting out a flat

To me, the company is not stubborn, they are simply abiding by the terms agreed upon when the rent was paid, since money is a proof of agreement

When you're dealing with companies, it is not advisable to do it individually. Your aunt should've employed the services of a legal counsel to be at the helm of affairs!
 
I think you should allow the company be. There has been an agreement in place already and there's nothing to be done. She signed the terms and didn't insert clauses that would make them leave anytime she wanted them to.
 
I could remember back in the year 2007, my aunt rented out a flat to a company and since then, the company have been using the flat and have not allowed my aunt to rent out the apartment to another company cos the flat is near a road side. My aunt once proposed to sell the house to the company but the company doesn't want to buy the flat so my sister wants to return their money and chase them out.

Now, the problem is the company won't packout and told my aunt they won't move out till their rent is due. My aunt already have 3 ready buys but she can't chase away the company that rented the apartment away.

Please I need you help on how my aunty can chase this stubborn company away and sell it.
I think they need a court case.
What is wrong with all these stubborn companies?
Your aunty will need to get the appropriate authorities involved in this case. She needs to get a lawyer involved at least.

Your aunty made a mistake from the beginning.
When going into business with a company like in her case, it is appropraite to involve a third party, like a lawyer.
You do not work individually in stuff like this.
 
The company is within their right to resist ejection from your aunt because their rent still subsist,so they are not stubborn.
However your aunt should explain the situation to her prospective buyers anyone of them that is willing to wait it out will be patient for the rent of the company to expire.
 
On their right, the corporation stands. She can't send them a quit notice as long as their house rent isn't up. It makes no difference to them if 100 people want to buy the house. You can't expect them to leave while their rent is still being paid.
 
If I were your Aunt, I will leave it on rent age since the tenant does not default on payment of rent.

Nevertheless, I don't know her reason for wanting to sell the property, she should wait until their rent I due then show them the way out.
Thanks for your wonderful comment, I think the aunt I the one breaching the contract agreement by wanting to sell when the company payment has not lapsed, I believe she should wait for the rent to be due before selling it off.
 
This company is within their right to occupy that house, your anty has no right to chase them away until their rent is due, the only advice I can give you is that your anty should let their rent to expire, that way there won't be need for any dispute resolution, all parties are satisfied.

Your aunty need to follow the guidelines on how properties is been rented out. If the tenants haven't used up to what they pay, you Aunt don't have any right to chase them out of the house. Even after using up their renting fee, she still need to serve them a document informing them of her intention to sell the property and allow them to look for rent elsewhere.
 
if your auntie is not making profit from the flat in which she rented out then the best is to sell it away. if the company refuses to buy then they need to go for other people to buy.

This is very important and necessary. Before renting out a building there must be an agreement between the tenant and the landlord. If any of the parties breaches the agreement then they can be sued.
 
If the person's rent has expired then your auntie has every right to involve the police if needs be. You can't occupy someone's property when you are not ready to pay for it.
 
Personally I think renting is not supposed to have much problem or challenges of such nature maybe because no agreement was made between the two parties for the period of there stay.

Actually. they are on there righ is no their concern if numbers of people are in need of the house to buy because I believe they might have had an agreement before accepting the apartment.

In situations like this everything must be done legally , like involving a appropriate authority depending on the country you are staying. Some people like this will always be dealt with if they are guilty or the one at fault.
 
From your explanation here about the property,the company and your aunty has already enter into an agreement for a period of time,so it should be a case of allowing them to see out their rent out or you negotiate with them.

That is just the basic truth, sometimes it is good for us to put ourself in other people's shoes,it will not be good for the occupant of the house to be ejected just like that,things like this should be given a human face.
 
First of all, you need to understand the legal requirements for evicting a tenant in your state. Then, you approach a lawyer to take over management of the property and serve them a notice. If it is a good lawyer, he would even collect compensation for you.
 
When you rent out, you normally have a written contract where terms and conditions are clearly explained. If the renter is not leaving the flat you can easily take appropriate action. I don't think it is difficult.
