Renting out a flat

Renting out flat may be easier when you are staying in an urban area. This is because people living in urban areas have money to afford flat rentage apartment.

The company is right on this issue since their rent is yet to due they have the right to still remain in your aunt property. The only thing your aunt could do is to wait for their rent to expire, if they refused to leave after the expiration of their rent, she should involve the police to charge them to court.

Just as you have rightly said, the company's rent has not expired. And as far as I know one's rent has to expire before the owner of a house can decide to remove the tenant or not. And your aunt can't just throw the company out like that without going through the necessary process of removing them from the house. This is just my opinion.

I could remember back in the year 2007, my aunt rented out a flat to a company and since then, the company have been using the flat and have not allowed my aunt to rent out the apartment to another company cos the flat is near a road side. My aunt once proposed to sell the house to the company but the company doesn't want to buy the flat so my sister wants to return their money and chase them out.

Now, the problem is the company won't packout and told my aunt they won't move out till their rent is due. My aunt already have 3 ready buys but she can't chase away the company that rented the apartment away.

Please I need you help on how my aunty can chase this stubborn company away and sell it.
I think the best way for your aunty is not o calm down for the company to make use of their house rent money finish and before you know it the due date will come and the will move out at the end.

That's just it. I don't think they will want to stick to their guns if their rents were expired already. If their rent tenue is still valid to this point, there is nothing your aunty can do than to wait for the rent to expire

I think it depends on the law of the country. Here you cannot just evict a tenant for not paying rent regardless of the lease contract. But you can file a case in the local community to resolve the problem. The tenant can be forced to leave when there are evidences that show the unwillingness to pay rent.

I see no reason selling the property out tho, since she gets her rent. And i believe the company do not owe her rent. And she really has no right to force them out suddenly mostly when their rent has not expired. The company has every right to take legal action against her. In such cases, a quick noticed should be given and a reasonable amount of time for the company to be able to find somewhere else and also be ready to return some amount of their rent, if it gas not expire. I would advice she leave it on rentage tho

You cannot just chase someone out like that because if you do it in this way the have the right to take you to the court of law because the agreement you made with them is not yet due, until the rent expired they still have ownership and full right to that building.

When a tenant wouldn't pay rent for 2 months the landlord can complain to the local government for adjudication. Normally what happens is a compromise that the tenant would pay (later) but they cannot be evicted unless he does not fulfill the compromise on the arrears.

Renting out a room in a house that you live in can be very demanding because of the fact that the occupant may be a very troublesome person and can create problem for the house owner

If a tenant doesn't pay the house rent, I think the owner of the land has the right to do whatever by sending the person packing, what is the need for the landlord to report it to the local government authority ?

With what you just posted here now it's very obvious that your aunt is the greedy one here and she's the one that wants to default the agreement between both parties. Since she knows her intention t sell the house why did she rent it out

Make an informed decision: The first thing you must do is be sure if you really want to rent out your flat/home. Renting out a place that you have stayed ,or renting a flat as an estate consultant is good and comfortable because any customer that collect that kind of apartment is in money and that kind of place is good married couples or families

I think that company is just being ignorant. Seeing the benefits they get from the location of that place would motivate them to purchase it but I guess they are not Smart.

To me before renting out an apartment , the renter will be issued a form to fill and also accept the terms and conditions and if he or she violate the conditions or rules , I will submit it to my lawyer to take action immediately

We also have that here, it is called a lease contract where the rules are stated. However, most of the apartment owners are not very strict particularly with the allowed rental increase of 20% every year. They understand the plight of the apartment dwellers that rental must be stable somehow.

The company has every right to make the claims they are making as long as they are defaulting in payment. Even if your aunty decides to pay them a part of the rent, they still have a choice to accept it or decline her offer.

You Aunty need to wait for their rent to expire and if they refuse to leave the flat then it can seek the services of lawyer to evacuate them.

The bitter truth innhis matter of your aunty and her tenants is that, your aunt really don't have any solid case here to present even if it were to be a court case. In can't find any infractions from her tenants in this matter whatsoever

In my own opinion I see no reason while your anty should send the company packing because their rent is not yet due, the only time she can send them out is when their rent has expire
