Renting out a flat

Check your lease!

So before you rent your flat, check your lease for a binding contract that does not allow it to be fulfilled. ... If your lease clearly states that slitting is prohibited, you are not allowed to do so, and you will need written permission from the landlord if you wish to leave the property.

There is term and agreement documented by law. These terms and conditions are to be signed by the landlord or lady and the would be Tennants. Anything contravening these conditions will be found illegal in courts. So I think your sister or aunt should wait till when the tenacity expires.
 
when renting out a house to someone or when you are renting from someone you have to make sure there is an agreement between the two parties and all agreements must be strictly followed,the only thing she can do is to be calm till their house rent lapse
 
Your aunt will have to chill.bif you go to court, they'll win cause they rent isn't due .when their rent is due, they'll move out. Seeing buyers now doesn't mean you won't see later .Your aunt should seek the services of a very good legal practitioner .
 
She as no choice ooo, because I guess that's what the court will say! I would av advice you to tell your aunt she should take her to court, but she received the money already. Its a bit difficult now... But have you tried going to court?
 
I could remember back in the year 2007, my aunt rented out a flat to a company and since then, the company have been using the flat and have not allowed my aunt to rent out the apartment to another company cos the flat is near a road side. My aunt once proposed to sell the house to the company but the company doesn't want to buy the flat so my sister wants to return their money and chase them out.

Now, the problem is the company won't packout and told my aunt they won't move out till their rent is due. My aunt already have 3 ready buys but she can't chase away the company that rented the apartment away.

Please I need you help on how my aunty can chase this stubborn company away and sell it.
if the company and your aunt made an agreement before the renting of the apartment and the company seems to be going against the content of the agreement letter, I think it is best for her to proceed to the law court and sue them. It will be better like that
 
Yes Is a good idea I tell you, renting a flat out, to some body that is really ready to you every month or every year as the case may be is a welcome, but make sure you save the money at least to buy for your self another flat too that can be giving you money on daily basis,
 
Presently the company has right over that plot of land, but the best thing for your aunt to do is for she to take the case to cult, then she can balance them their money for the remaining years
 
Lol, company can't just exceed the duration of their stay. Remember you're dealing with well orientated organization. Agreement must be reached before a company can endorse you. If the terms if the agreement isn't met, the company can't evacuate the position until it expires.
 
From a legal point of view,the company has every right to stay until their rent expires. So either your aunty waits for their rent to expire or have an agreement with the buyers to buy it and takeover ownership while the await the company's tenure.
 
Depends how long your aunt renting the apartment to them, because them can't stay more than their money because when their rent time is due them can leave.

The company is not at fault because the agreement between them has not due, and your aunt should have stopped collecting money from then company, the only solution is to use the law to force them out.

Since their rent is not yet expired, l don't think it will be easy for your family to chase the company away and sell the flat or use it for other purposes. l suggest you wait patiently for the rent to expire.

Since the rent has not expired , you can't do anything about chasing the out , it will be like forcefully ejecting them out of the apartment when they still have the right to be in the house,

That is exactly what l think. if would have been better if the company had agreed to move willingly, but forecefully, l don't think it will work.

And this is why I always recommend people to be careful who you you give your property when it comes to renting it out. That apartment is your aunt's property and that company has no right to dictate your aunt. If your aunt got an offer from buyers and if that company does not want to move out, then why don't your aunt sell that apartment to that company for a much HIGHER price than what other buyers are offering?
 
Its only fair that your aunty wait for their rent to elapse this way she can give them an quit notice and they will not have any other choice than to move out. If the company says they don't want refund and want to stay till their rent expires I see reason with them.
 
You can't get the best help from here as it is now. What your aunty need to do is to get the services of competent lawyers involved now to get to the bottom of this situation before she suffers loses from it as she is already suffering from
 
If they are still on their rent and the rent your aunty collected form them has not expired for them to either renew or vacate the property, there is not much your aunt can do than to allow their rent expire first before ejecting them out. That's how it should be
 
She would have signed a legal document just incase there is any form of contract breach.and others ,i feel that was the only mistake your aunt make them , i hope she chase them out
