Renting out a flat

The first thing is to look for the lease, if it has not ended, you have to wait, if there is any lack in the contract by the company. Issues like this are tough, involving a lawyer may not sort the problem, the tenant has a right to use up his rentage and leave as at when due, I will advise that she exercises patience and allow the tenants finish up their tenure.

I could remember back in the year 2007, my aunt rented out a flat to a company and since then, the company have been using the flat and have not allowed my aunt to rent out the apartment to another company cos the flat is near a road side. My aunt once proposed to sell the house to the company but the company doesn't want to buy the flat so my sister wants to return their money and chase them out.

Now, the problem is the company won't packout and told my aunt they won't move out till their rent is due. My aunt already have 3 ready buys but she can't chase away the company that rented the apartment away.

Please I need you help on how my aunty can chase this stubborn company away and sell it.
Your aunt needs to follow the proper measures to let out the company out of her apartment .
If the company have already paid her,then she has no right to chase them out before their money is over.
And again your aunt should give them a notice early enough so that they can look for another place to rent

She has just sue the company to court but do you think that is the right step to follow, I think she should just try and sell out the building to the company by any means cos I feel the company is having issues or she should increase the rent.
 
Its all about the agreement between you and the company, if there is a stated clause in the document that once there is a disagreement between you and the company, like the company does not want you to fulfil your wish as the owner. Then you can take a definite decision on the matter.
 
Your sister can do the job alone, she needs to enlist the service of of a lawyer. Let your sister look for A reputable law firm in your city and table her matter to them, especially the real estate law firm. do you know the right steps to take in order to evict the tenant from your sister's real estate property. She can also involve law enforcement agencies and she should be ready to refund the remaining of the rate to the tenant in order to chase them out effectively.

What your auntie wants to do is called breach of contract. She rent the flat to a company and they have paid in full and she can't just wake up one morning to threaten them that she wants to sell the flat. It is wrong and she can sued by the company, if she goes beyond boundary.
 
Your aunt should wait until their rent is due, they have an agreement. Your aunt cannot just decide that they should leave because she got a buyer. If it a case whereby the company has been defaulting in paying their rent and have refused to pay yet they still want to stay in her compound then we have a problem but their money is not expired, if the building has prospects and value, no matter how long it takes for their rent to expire immediately they leave your aunt will have buying knocking on her door.

That is right, I think she should just wait for the company to use their rent finish before chasing them cos it is very dangerous to treating the company.

Maybe if she talks to the manager of the company, they will listen to her or if she can meet with the CEO, things could be solved.

She shouldn't worry about the sale, there will always be buyer and just like you have said the property is opposite the road.
 
She can actually chase them out based on the tenure of their rent contract. For properties rented out for a year the tenant is entitled to 6 months notice. If they pay rent yearly, I think your aunt can actually serve them a notice at this point. Three years is actually a long time to take someone's property without leaving.
 
Well renting out a flat is quite lucrative a 2-bedroom flat 3-bedroom flat no matter what people will rent. it so all you have to do is ensure you have a lot of facility is put in place to make life it is quite lucrative when you have all the necessary facilities and I found living in flat actually easier than live in a bungalow.
 
They already had an agreement so she cannot chase them out as they said till their rent is due. So once the rent is due they can now peacefully leave then she can sell out the house but pending when that happens, she just needs to be patient because an agreement is an agreement.
 
Yes company can not leave in this way because they paid you the rent and how they can withdraw it and if you follow the rules then you should wait until time of agreement finishes. If you have a written agreement and they are violating then go to the court.
 
This company is within their right to occupy that house, your anty has no right to chase them away until their rent is due, the only advice I can give you is that your anty should let their rent to expire, that way there won't be need for any dispute resolution, all parties are satisfied.

I am afraid, since there time in the room has not expired you may not be able to chase the out of the room. You made an agreement with the company for which they paid you for that time frame. It is only normal for their time to completely elapse before you could think of selling the room to another buyer. If you take the case to the police or law court, you are likely to loose the case.

It is really painful when giving out a house build for the purpose of letting it out to create income, and the party involved doesnt keep to his or her own part of the deal they signed. I will advice you get a property lawyer to fill a case against the tenant occupying the said building.
