Renting out a flat

I could remember back in the year 2007, my aunt rented out a flat to a company and since then, the company have been using the flat and have not allowed my aunt to rent out the apartment to another company cos the flat is near a road side. My aunt once proposed to sell the house to the company but the company doesn't want to buy the flat so my sister wants to return their money and chase them out.

Now, the problem is the company won't packout and told my aunt they won't move out till their rent is due. My aunt already have 3 ready buys but she can't chase away the company that rented the apartment away.

Please I need you help on how my aunty can chase this stubborn company away and sell it.

Your aunty need to follow the guidelines on how properties is been rented out. If the tenants haven't used up to what they pay, you Aunt don't have any right to chase them out of the house. Even after using up their renting fee, she still need to serve them a document informing them of her intention to sell the property and allow them to look for rent elsewhere.
 
If I were your Aunt, I will leave it on rent age since the tenant does not default on payment of rent.

Nevertheless, I don't know her reason for wanting to sell the property, she should wait until their rent I due then show them the way out.
 
You need to involve lawsuit .. problems like these are bound to occur if lawyers are not initially involved.
 
This company is within their right to occupy that house, your anty has no right to chase them away until their rent is due, the only advice I can give you is that your anty should let their rent to expire, that way there won't be need for any dispute resolution, all parties are satisfied.
 
From what I understand with a flat, it is a small house. But whatever structure it is my take on the company is that they had leased it from your aunt. A lease is a long term contract of renting the place maybe 6 months or longer. If I were the company I would also refuse to vacate the flat if it is beneficial to our business. As the tenant our company is protected by the lease contract and you cannot just return our money (rental paid in advance) and make us go. Get a lawyer and I will see you in court.
 
From your statement, I chose to believe that the building is on lease agreement cause 2007 till now is 13years or even more. The only thing that could be done is to revise the lease agreement again to see the dissolvement agreement only if there’s any but if there’s none she’ll require the services of an accounting firm to evaluate how much it’ll cost her to pay them off
 
The company stands on their right. As long as their house rent hasn't expired, she cannot give them a quit notice. It is none of their concern if 100 people are lining up to buy the house. You can't expect them to move out when their house rent is still reading.

He who is your aunt should talk to the good property dealer he will talk to the company well he knows how to talk what good benefit

I guess your aunt reached a renting consensus with the company before given out your house for them. If their renting terms is not due that means your aunt is acting on a trickery way. But if the reverse its the case, then your aunt should drive the company to court. That side is the best to settle any disagreement in renting and buying issues.
 
She can not use force to send them parking.
The option she has is to explain to all her potential buyers about the agreement she made with the company,if they still need the building they will buy and be the new land lord to the company.
 
To save the stress from the beginning, your aunt should have leased instead of rented the flat. Business owner especially microfinance banks always love an area like that of your aunt's flat. Your aunt will just keep calm till their rentage expires because they are still have right to the flat.

It would be difficult to get the occupant out of the said apartment if the rental duration hasn't expired. Revert back to the tenancy agreement signed by both parties, you will notice the occupant hasn't been faulted by the occupant. The best is to negotiate with the occupant, making him/her see reasons to leave without legal actions. The way tenancy law are constituted in most countries it favours the occupant. Taking legal actions should be the last option.
 
You need to confirm from your aunty if the property was rented out to the company or leased, because most rented apartments are paid either on monthly basis or yearly. If it's on rent she can either balance them the remaining part of the rent or she allow the rent to expire then they will move. But if the apartment was leased, found out from her how when the lease is expected to expire, because most lease tenors are usually long, and try to pay off the remaining lease tenor, if they refuse she should involve a property lawyer to handle it.
 
Your aunt should seek the services of a very good legal practitioner . The stubborn company would be served a quit notice and given a few months to leave. after the expiration of the quit notice the matter will be taken to the court of law.
 
There shy have been an agreement between your aunt and the company before renting it out for them, this should have been among th terms and conditions they must adhere to, so your sister have no choice than to leave them till web their rent is due
 
The company's rent is not due, so they are within their right to occupy the flat.

Your aunty should wait and resist from disturbing them.

Even if she goes to court, the verdict will be in favour of the company.
